Terms of Service

The structural agreement between you and Aura Brilliant.

1. Acceptance of Terms

This website, aurabrilliantjewelry.com (the "Site"), is operated by AURABRILLIANT LLC ("Aura Brilliant," "Company," "we," "us," or "our"). By accessing the Site, creating an account, or placing an order, you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"), our Returns & Resilience Protocol, and our Privacy Policy, each incorporated by reference. If you do not agree to these Terms, do not use the Site or place an order.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and capable of forming a binding contract to use the Site or place an order. By placing an order, you represent that you meet this requirement.

3. Products & Descriptions

We describe our products ("Products," referred to elsewhere on this Site as "archives" or "structural bands") using specific technical language, including material composition, density, hardness, and dimensional tolerances. Reasonable manufacturing variance applies to all stated measurements and weights unless a specific tolerance range is given. Product images and renderings are provided for illustrative reference; minor variation in finish, pattern (including Damascus/Causal Stratigraphy patterning, which is unique to each piece by nature of the forging process), and color between the image and the delivered Product does not constitute a defect. We reserve the right to limit quantities, discontinue any Product, or correct errors in Product descriptions or pricing at any time without prior notice, including after an order has been submitted, in which case we will notify you and offer a full refund for the affected order.

4. Orders, Pricing & Payment

All prices are listed in USD and, per our DDP (Delivered Duty Paid) shipping model, include applicable US import duties and taxes at the time of purchase. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or unavailable inventory; if we cancel an order after payment has been captured, we will issue a full refund. In the event a Product is listed at an incorrect price due to typographical, technical, or pricing error, we reserve the right to cancel any order placed at the incorrect price, whether or not the order has been confirmed.

Estimated delivery windows stated on this Site (currently 5–10 business days within the United States) are good-faith estimates, not guarantees. Where required by the FTC Mail, Internet, or Telephone Order Merchandise Rule, if we are unable to ship within the stated time or, where no time is stated, within 30 days, we will notify you and provide the option to consent to the delay or cancel your order for a full refund.

5. Shipping & Risk of Loss

Risk of loss and title to Products pass to you upon our delivery of the Product to the carrier. We are not responsible for delays, loss, or damage occurring after this point, except as expressly provided under the Returns & Resilience Protocol. Where a shipment is lost or damaged in transit, we will work with you and the carrier in good faith to resolve the claim, but our liability in connection with carrier loss or damage is limited to the remedies available under that Protocol.

6. Disclaimer of Warranties

Except as expressly set forth in the Returns & Resilience Protocol and the Aura Resilience Guarantee, Products and the Site are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law. We do not warrant that the Site will be uninterrupted or error-free, or that Product descriptions, pricing, or other content on the Site is accurate, complete, or current. 7. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Aura Brilliant, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Site or any Product, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages. To the fullest extent permitted by applicable law, our total aggregate liability to you for any claim arising out of or relating to these Terms or any Product will not exceed the amount you paid for the Product giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, fraud, or personal injury caused by a defective product where such limitation is prohibited by the law of your state of residence.

8. Intellectual Property

All content on the Site, including text, graphics, logos, product names ("Aura Brilliant," "The Structural Vault," "Causal Stratigraphy," and other Site-specific terminology), images, and the compilation thereof, is the property of Aura Brilliant or its licensors and is protected by US and international intellectual property law. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent. By submitting a product review, photo, or other content to the Site, you grant Aura Brilliant a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, and display that content in connection with marketing the Site and its Products.

9. Prohibited Uses

  • Using the Site for any unlawful purpose or in violation of these Terms.
  • Attempting to interfere with, compromise the security of, or disrupt the Site or its underlying infrastructure.
  • Using automated means (bots, scrapers) to access or extract data from the Site without our prior written consent.
  • Submitting false, fraudulent, or unauthorized payment information, or engaging in chargeback fraud.
  • Reselling Products in a manner that falsely implies an official partnership, endorsement, or authorized-retailer relationship with Aura Brilliant, without our prior written consent.

10. Indemnification

You agree to indemnify, defend, and hold harmless Aura Brilliant and its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your breach of these Terms, your misuse of any Product, or your violation of any law or the rights of a third party.

11. Dispute Resolution & Arbitration

Except for claims that qualify for small claims court, any dispute arising out of or relating to these Terms or any Product will be resolved by binding arbitration administered under the Federal Arbitration Act, rather than in court, except that either party may bring an individual claim in small claims court. YOU AND AURA BRILLIANT EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. You may opt out of this arbitration provision within 30 days of your first order by sending written notice to support@aurabrilliantjewelry.com with the subject line "Arbitration Opt-Out," including your name and order number. 12. Governing Law & Venue

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles, except where superseded by federal law or by a mandatory consumer-protection law of your state of residence that cannot be waived by agreement. Any dispute not subject to arbitration under Section 11 will be brought exclusively in the state or federal courts with jurisdiction over Wyoming, and you consent to the personal jurisdiction of those courts. Notices, returns, and customer service correspondence are handled at our Houston, Texas operational address listed in the footer of this page and in the Returns & Resilience Protocol; that address does not affect the choice of governing law in this Section.

13. Force Majeure

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disaster, war, terrorism, labor dispute, customs delay, carrier disruption, or governmental action.

14. Privacy & Marketing Communications

Our collection and use of personal information is described in our Your Privacy Choices page and Privacy Policy. If you subscribe to "The Archive Briefing" or otherwise opt in to marketing communications, you may unsubscribe at any time via the link provided in each communication. We comply with the CAN-SPAM Act for email marketing and, where applicable, obtain separate consent for SMS communications as required under the Telephone Consumer Protection Act (TCPA).

15. Additional Terms for California Residents

Under California Civil Code Section 1789.3, California residents are entitled to the following consumer rights notice: complaints regarding the Site may be directed to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

17. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect. These Terms, together with the Returns & Resilience Protocol and Privacy Policy, constitute the entire agreement between you and Aura Brilliant regarding the Site and Products.
